Main Purpose of the Job

 

To provide legal advice and support of the highest professional standard to various AECI business units.

 

Role and Responsibilities:

 

Legal Advisory Services

 

  • Provide legal advisory services to AECI businesses
  • Provide advice to and support the management team and business units in mitigating legal related risks
  • Create and maintain legal framework for the activities of the AECI Group

 

Stakeholder Management

 

  • Develop, revise, advise and establish Contracts Strategies taking cognizance of Strategic Sourcing initiatives
  • Understand customer requirements and correctly interpret requirements and scope of contract information to select correct suppliers, obtain quotes, place orders and / or send out tenders and award contracts accordingly
  • Manage and monitor that suppliers / contractors are selected, approved and audited against defined standards
  • Participate in project teams and serve as a specialist advisor on contracting issues
  • Establish and manage active group supply contract register for all strategic sourcing contracts
  • Ensure all supply contracts are aligned to group policies and supported or approved by group legal
  • Assist compile tender documentation and special conditions for high value orders and/or contracts
  • Review and recommend appropriate General and Special Contract Conditions/Documentation
  • Maintain close links with Contracts section in terms of new and existing legislation and contract requirements Coordinate, facilitate and resolve contractual Claims and Disputes of Contracts

  • Conduct research and develop legal frameworks, analyse local and international trends that could impact the business.
  • Conduct assessment on labour legislation compliance, locally and cross-border
  • Conduct business improvement initiatives on ethics and corporate governance
  • Stay abreast of Legal Legislation, Compliance and Regulatory issues, locally and cross-border

 

 

Qualification and Experience

 

  • Recognised legal degree (B Com Law/BA Law/LLB).
  • Admitted attorney of the High Court.
  • 8-10 years work experience in a legal environment
  • Substantial experience in corporate commercial matters
  • Knowledge of applicable legislation including corporate law, competition law, environmental law, explosives law, mining law, tax law, labour law, etc.
  • In depth knowledge of legal processes and procedures
  • Experience in a contractual/procurement environment
